Powervox Scheduling Terms of Use

Powervox Scheduling Terms of Use

Effective Date: November 4, 2026

Please read these terms before you request or book an appointment. They are short and written in plain English, but they affect your rights, including by limiting Powervox's liability to the extent the law allows (see the Disclaimers and Limitation of Liability sections below).

1. About these terms

These Powervox Scheduling Terms of Use ("Scheduling Terms") apply to you if you are a patient or other individual who uses Powervox's online scheduling tool made available at powervox.io (including its subdomains), or the Powervox scheduling widget linked to from, or embedded on, a dental practice's website (together, the "Scheduling Services"), to request, book, change or cancel a dental appointment. "Powervox", "we", "us" and "our" mean Powervox, LLC. "You" and "your" mean the person using the Scheduling Services.

The Scheduling Services are also covered by the Powervox Terms of Service. If these Scheduling Terms conflict with the Powervox Terms of Service with respect to your use of the Scheduling Services, these Scheduling Terms prevail. The Powervox Terms of Service continue to apply to any other use of Powervox's websites or services.

2. Accepting these terms

Where a notice of, or a link to, these Scheduling Terms is presented on a booking screen or within the scheduling widget, you agree to these Scheduling Terms by continuing to use the Scheduling Services or, where a checkbox, button or other acknowledgment is presented, by giving that acknowledgment.

If you do not agree to these Scheduling Terms, please do not use the Scheduling Services. You can still contact the dental practice directly to make an appointment.

3. We provide scheduling on behalf of your dental practice

Powervox provides the Scheduling Services on behalf of the dental practice with which you are requesting an appointment (the "Practice"). Powervox is not a dental or healthcare provider and does not provide dental or medical care or advice.

The Practice, not Powervox, decides whether to confirm, change or cancel any appointment, and the Practice is solely responsible for the dental or medical care it provides, its availability and opening hours, its prices and fees, and whether your insurance covers any service.

Choosing or entering an insurance carrier in the Scheduling Services does not confirm your coverage or eligibility; please check with the Practice or your insurer.

Submitting a booking request does not by itself guarantee an appointment. A booking request is not confirmed until the Practice confirms it, and appointment times shown in the Scheduling Services may change until then. Changes and cancellations are subject to the Practice's own policies, including any cancellation or missed-appointment policy the Practice has.

4. Not for emergencies

The Scheduling Services are not for emergencies. Selecting an emergency exam as your reason for visit does not mean that anyone will see or respond to your request right away. If you have a medical or dental emergency, call 911 or go to the nearest emergency room, or contact the Practice directly by phone.

5. Your information and who you book for

When you use the Scheduling Services you will be asked for information such as your name, date of birth, phone number and email address, whether you are a new or existing patient, the reason for your visit and, in some cases, your insurance carrier. We may send a verification code to your email address or phone number to confirm your request.

You agree to give accurate, current and complete information, and to use only an email address and phone number that you are entitled to use.

You may book only for yourself or for someone you are authorized to book for, such as your minor child or a person for whom you are a legal guardian or otherwise have permission to act. If you book for someone else, you confirm that you have their permission or the legal authority to share their information with the Practice and with Powervox for this purpose.

6. Privacy

Powervox handles the information you submit through the Scheduling Services on behalf of the Practice, as the Practice's business associate under HIPAA (the federal law that protects health information).

The Practice's HIPAA Notice of Privacy Practices governs how the Practice uses and discloses your health information and describes your rights regarding it. The Practice should make that notice available where you book. Requests about your health information, such as a request to access or correct it, should be sent to the Practice.

The Powervox Scheduling Privacy Notice explains how Powervox collects, uses, shares and protects information submitted through the Scheduling Services. Powervox does not sell your health information and does not use it for advertising.

7. Text messages from the Practice

On the final booking screen you may be offered the option to receive appointment-related text messages from the Practice. Giving that consent is optional and is not required to book an appointment. Any consent you give is given to the Practice, and those text messages are the Practice's messages, sent at the Practice's direction. Message and data rates may apply. You can withdraw your consent at any time by following any opt-out instructions in a message or by contacting the Practice.

8. Acceptable use

When using the Scheduling Services, you agree not to:

  • use them for any purpose other than requesting, booking, changing or cancelling genuine appointments;
  • submit false, misleading or fraudulent requests, or impersonate any person;
  • submit another person's information without their permission or legal authority;
  • interfere with, disrupt or overload the Scheduling Services, or try to gain unauthorized access to them or to any system or data connected to them;
  • use bots, scrapers or other automated means to access the Scheduling Services or to collect information from them;
  • copy, modify, reverse engineer or create derivative works of the Scheduling Services, except to the extent applicable law allows; or
  • use the Scheduling Services in any way that is unlawful or infringes anyone's rights.

We may suspend or block access to the Scheduling Services, or decline or remove a booking request, if we reasonably believe these Scheduling Terms have been breached or to protect the Scheduling Services, the Practice or other users.

9. Powervox intellectual property

The Scheduling Services, including their software, design, text and graphics, and Powervox's names and logos, are owned by Powervox or its licensors and are protected by intellectual property laws. We give you a limited, personal, non-transferable and revocable permission to use the Scheduling Services for their intended purpose in accordance with these Scheduling Terms. No other rights are granted to you. The Practice's own names, website, logos and content belong to the Practice.

10. Disclaimers

To the extent permitted by law, the Scheduling Services are provided "as is" and "as available". We do not promise that the Scheduling Services will be uninterrupted, error-free or always available, or that any particular appointment time will be available or confirmed, and we disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose and non-infringement.

To the extent permitted by law, Powervox is not responsible for the care, advice, services, availability, prices, insurance decisions or communications of any Practice.

11. Limitation of liability

To the fullest extent permitted by law, Powervox and its affiliates, officers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, arising out of or relating to your use of, or inability to use, the Scheduling Services.

To the fullest extent permitted by law, Powervox's total liability to you for all claims arising out of or relating to these Scheduling Terms or the Scheduling Services will not exceed one hundred dollars ($100).

Nothing in these Scheduling Terms excludes or limits any liability that cannot be excluded or limited under applicable law. Some states do not allow certain warranties or types of damages to be excluded or limited, so some of the exclusions and limitations above may not apply to you. Nothing in these Scheduling Terms limits your rights regarding your health information under HIPAA or other applicable law, or the Practice's responsibilities to you.

12. Changes to these Scheduling Terms and to the Scheduling Services

We may update these Scheduling Terms from time to time. When we do, we will post the updated version with a new effective date and, if the changes are material, we will give notice through the Scheduling Services before the changes take effect. Updated terms apply to your use of the Scheduling Services after their effective date and do not affect a booking request you submitted before then. If you continue to use the Scheduling Services after that date, you accept the updated terms.

We may change, suspend or discontinue all or part of the Scheduling Services at any time, and a Practice may stop offering them.

13. Governing law

These Scheduling Terms are governed by the laws of the State of Kansas, without regard to conflict of law principles. Any dispute arising out of or relating to these Scheduling Terms or the Scheduling Services will be brought in the state or federal courts located in Johnson County, Kansas, except to the extent the law of the place where you live gives you the right to bring proceedings in your local courts.

14. General

If any part of these Scheduling Terms is found to be unenforceable, the rest will remain in effect. If we do not enforce any part of these Scheduling Terms, that is not a waiver of our right to do so later. You may not transfer your rights under these Scheduling Terms. Together with the Powervox Terms of Service, these Scheduling Terms are the entire agreement between you and Powervox about your use of the Scheduling Services.
